AVALON TOP LLC / LEGAL
Terms of Service
Effective and last updated:
These Terms of Service govern your use of the Avalon Top LLC website and its campaign brief tool. Please read them before using the website. If you do not agree with these terms, please discontinue use. Paid advertising services require a separate written agreement.
1. Website information and inquiries
This website describes campaign strategy, paid media, creative, and analytics services offered by Avalon Top LLC. Website content is general information, not a binding proposal, professional advice for a specific situation, or a promise to accept a project.
Preparing a brief, sending an email, or discussing a possible project does not purchase services, create a client engagement, authorize ad spend, or launch a campaign. A project begins only under the arrangements agreed with the client.
2. Paid services, budgets, and agreements
Before paid work begins, the parties must agree in writing on the scope, deliverables, fees, payment terms, media budget, approvals, and any cancellation or refund terms. Those project-specific terms govern the engagement and take priority over these website terms if they conflict.
Media spend paid to an advertising platform is separate from Avalon Top LLC's service or management fees. Budget ranges in the brief tool are planning inputs in U.S. dollars, not service prices, quotes, or payment commitments. No payment is collected through the website's brief tool.
3. Advertising results and platform decisions
Advertising results vary with factors such as the offer, audience, market, budget, creative, competition, and customer experience. We do not guarantee a particular ranking, number of leads, sales volume, return on ad spend, ad approval, or uninterrupted platform access.
Campaign examples on this website are illustrative concepts, not client case studies or reported results. References to Google, Meta, TikTok, YouTube, or other platforms identify relevant services and do not by themselves imply endorsement, certification, or affiliation. Those platforms control their own policies, approvals, availability, and pricing.
4. Campaign briefs and communications
The brief tool prepares a text file on your device. It does not submit an inquiry or automatically send the file to us. You decide whether to email a message or attach your brief using your own email application. Keep a copy of any information you need.
Provide information you are authorized to share and that is accurate to the best of your knowledge. Do not include passwords, payment card details, or unnecessary sensitive personal information. Sending material for an inquiry does not transfer ownership of that material; intellectual property terms for paid deliverables belong in the separate client agreement.
5. Acceptable use
Use the website lawfully and respect the rights of others. Do not submit unlawful, fraudulent, infringing, or malicious material; impersonate another person or business; attempt unauthorized access; interfere with website availability; or bypass security controls. Nothing in these terms restricts activity that applicable law expressly permits.
6. Website content and third-party services
Website text, designs, graphics, and other materials are owned by Avalon Top LLC or their respective rights holders. You may view the website and use the brief tool for lawful personal or internal business evaluation. Other use of protected content requires the relevant owner's permission unless permitted by law. Third-party names and marks remain the property of their owners.
Links to third-party websites and services are provided for convenience. Their content, policies, and operation are controlled by those providers, and your use of them is subject to their applicable terms.
7. Website availability and limitations
We aim to keep the website useful and accurate, but content may contain errors or become outdated. Website features may be changed or temporarily unavailable. To the extent permitted by law, the website is provided as available without a guarantee of uninterrupted operation or suitability for a particular purpose.
To the extent permitted by applicable law, Avalon Top LLC is not responsible for indirect or consequential losses arising solely from use of this informational website or brief tool. Nothing in these terms excludes rights, remedies, or liability that cannot lawfully be excluded. Responsibility for paid services is addressed in the applicable client agreement.
8. Privacy
Our Privacy Policy explains how website visits, briefs, and email inquiries are handled. Please review it before choosing what information to share.
9. Changes and questions
Updated website terms will be posted here with a revised date and apply to use after they take effect, subject to applicable law. Changes to these website terms do not automatically amend an existing client agreement. Contact support@avalontopllc.com with questions about the website or these terms.
